Important Notice

Corporate Connect may revise these Terms and Conditions at any time by posting a new revision of this document on the Corporate Connect web site. Any revision will be effective immediately. Accordingly, users of this service should consult this document regularly to ensure that their activities conform to the most recent version. Any additional enquiries regarding these Terms and Conditions can be directed to Customer Support at support@corpconnect.com.au. You must notify Corporate Connect immediately of any change to your circumstances. You are responsible for and must pay the cost of all telecommunications and Internet access charges incurred when using Corporate Connect. You are responsible for all equipment and software necessary to access Corporate Connect as well as for the security and integrity of your data. Your use of Corporate Connect is your responsibility and entirely at your own risk.

Introduction

The Service provides access to the Internet that is used by millions of users. The benefits and privileges available from the Service and the Internet in general, must be balanced with duties and responsibilities of the user of the Service so that the other users of the Service can also have a productive and meaningful experience. Your use of the Service is subject to the following Terms and Conditions. Each customer of Corporate Connect is responsible for ensuring that the use of the Service through their account complies with these Terms and Conditions. The consequences of violation of these Terms and Conditions are detailed later in this document, and include the right for Corporate Connect to immediately terminate the provision of the Service.

Security

You are responsible for any misuse of the Service. You are also responsible for any misuse of your Service regardless of whether the misuse was with or without your consent. You must take every precaution to ensure that others do not gain unauthorized access to your Service. The Service must not be used to breach the security of another user or to attempt to gain access to any other person's computer, software or data, without the express knowledge and consent of such person. It also must not be used in any way to attempt to circumvent the user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging onto or making use of a server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security (such as password guessing programs, cracking tools, packet sniffers or network probing tools) is prohibited. You must not disrupt the Service or the networks through which the Service is provided. The Service also must not be used to interfere with computer networking or telecommunications services to any user, host or network, including, without limitation, denial of service attacks, flooding of a network, overloading a service, improper seizing and abuse of operator privileges and attempts to "crash" a host. The transmission or dissemination of any information or software, which contains a virus or other harmful feature also, is prohibited. You are solely responsible for the security of any device you choose to connect to the Service, including any data stored on that device.

Offensive Material

There may be content on the Internet or otherwise available through the Service which may be offensive to some individuals, or inappropriate for children. Corporate Connect accepts no responsibility for the content contained on the Internet or otherwise available through the Service. You assume the risk of accessing content through the Service, and Corporate Connect shall have no liability for any claims, losses, actions, damages, suits or proceedings arising out of or otherwise relating to access to such content. You are solely responsible for any information that you publish on the web or on other Internet services. You must ensure that the recipient of any content you transmit is of an appropriate age. Corporate Connect reserves the right to refuse to post or to remove any information or materials, in whole or in part, that it, in its sole discretion, deems to be offensive, indecent, or otherwise inappropriate regardless of whether such material or its dissemination is unlawful. This includes, but is not limited to: obscene material, fraudulent or deceptive statements, threatening, intimidating or harassing statements, or material which violates the privacy rights or property rights of others (copyrights or trade marks, for example) or is likely to be defamatory of another person. "Material" refers to all forms of communication including narrative descriptions, graphics (including photographs, illustrations, images, drawings and logos), executable programs, video recordings, and audio recordings. Commonwealth Legislation allows for the removal of certain prohibited or potentially prohibited content from access or to prevent users from accessing certain Internet content. Corporate Connect may take any steps necessary in order to ensure compliance with any relevant industry code of practice, notification or direction from the Australian Broadcasting Authority, including removing any content (including part or all of a website) from its servers, closing or suspending your Account, filtering Internet content made available to you, or restricting access to a particular website. Corporate Connect may take these steps at any time and without notice to you. Corporate Connect is under no obligation to monitor transmissions made on the Service. However, Corporate Connect or its agents, have the right to monitor such transmissions from time to time and to disclose the same in accordance with the Customer Terms and Conditions.

Illegal Activity

The Service must not be used for any activity that violates any local, state, federal or international law, orders or regulations. Prohibited activities include, but are not limited to: posting, disseminating, or in some cases accessing material which is unlawful. Such content includes but is not limited to; material containing detailed instruction in crime, violence or drug use; child pornography; bestiality; excessively violent or sexually violent material; real depictions of actual sexual activity; obscene material; racist or any hate related material; Pyramid or other illegal soliciting schemes; Disseminating any material which violates the copyright or other intellectual property rights of others. Any fraudulent activities, including impersonating any person or entity or forging anyone else's digital or manual signature.

E-mail

The Service must not be used to send unsolicited messages. This includes, but is not limited to, bulk mailing of commercial advertising, informational announcements, charity requests, petitions for signatures and political or religious messages. Such messages must only be sent to those who have explicitly requested it The Service must not be used to send messages to any individual who has indicated that he/she does not wish to receive messages from you. The Service may not be used to collect responses from unsolicited email sent from accounts on other Internet hosts or email services. Moreover, unsolicited email may not direct the recipient to any web site or other resource that uses the Corporate Connect network. Forging, altering or removing electronic mail headers is prohibited. "Mail bombing" is prohibited. The propagation of chain letters is similarly prohibited, whether or not the recipient wishes to receive such mailings. Corporate Connect is not responsible for the forwarding of email sent to any account that has been suspended or terminated. Such email will be returned to sender, ignored, deleted, or stored temporarily at the sole discretion of Corporate Connect.

Messages posted to newsgroups must comply with the written charters or FAQs for those newsgroups. Advertisements, solicitations or other commercial messages should be posted only in those newsgroups whose charters or FAQs explicitly permit them. You are responsible for determining the policies of a given newsgroup before posting to it. Posting or cross-posting the same or substantially similar messages is prohibited. Forging, altering or removing header information is prohibited. This includes attempting to circumvent the approval process for posting to a moderated newsgroup. You may not attempt to "flood" or disrupt Usenet newsgroups. Messages may not be cancelled, except by the author or by official newsgroup moderators performing their duties.

IRC - (CHAT)

The Service may be used to participate in "chat" discussions. These discussions may be hosted by third party servers or may not involve any servers at all. In all cases, Corporate Connect does not normally monitor the contents of the discussion and is not liable for the contents of any communications made via Internet chat. The Service must not be used to perform chat "flooding". This includes the use of automated programs, such as "bots" or "clones". Automated programs must not be used when the account holder is not physically present at the device. The Service must not be used to send messages which disrupt another Internet user's equipment, including software, hardware and user display. The Service must not be used to access any chat server in violation of the acceptable use policy of that server. The Service must not be used to manipulate any chat server in order to harass or disconnect other Internet users, or to gain privileges which have not been authorized. A customer must not use the Service to connect to chat servers or channels from which they have been previously banned. The Services must not be used to continue to send chat messages to an Internet user who has indicated their desire to not receive such messages. Forging, altering or obscuring your identity while participating in chat sessions is forbidden.

Other Limitations

Users must ensure that their activity on the Corporate Connect network does not place an unusually large burden on the network. This is necessary to ensure that the quality of the service is not impacted upon given the physical constraints of the network. Users must also ensure that their activity does not improperly restrict, inhibit or degrade any other user's use of the Service. In addition, users must ensure that their activity does not improperly restrict, inhibit, disrupt, degrade or impede Corporate Connects' ability to deliver the Service and monitor the Service, backbone, network nodes, and other network services and components. You must not resell, share or otherwise distribute the Service (or any portion thereof) to any third party without the prior written consent of Corporate Connect.

Breach of Terms and Conditions

Corporate Connect is not obligated to regularly monitor your usage of the Service except in relation to accounting and billing. However, in Corporate Connect's effort to promote good citizenship within the Internet community, it will respond appropriately if it becomes aware that you or someone with access to your Service has breached these Terms and Conditions, or has used the Service in an inappropriate manner. Although Corporate Connect has no obligation to monitor the Service, Corporate Connect reserves the right to monitor your bandwidth, usage or content, to identify breaches of these Terms and Conditions; and to protect the Corporate Connect network and other users of this Service. Corporate Connect will advise customers of inappropriate behavior and take any necessary corrective action it deems necessary in its sole discretion to rectify the matter. However, if the Service is used in a way which Corporate Connect in its sole discretion, believes violates these Terms and Conditions, Corporate Connect may take any responsive action it deems appropriate. Such actions include, but are not limited to, temporary or permanent removal of content, cancellation of newsgroup posts, filtering of Internet transmissions, and/or the immediate suspension or termination of all or any portion of the Service. Corporate Connect has no liability for any such responsive actions. The above-described actions are not Corporate Connect's exclusive remedies and Corporate Connect and its employees or agents may take any other legal or technical action it deems appropriate. Corporate Connect reserves the right to investigate suspected violations of these Terms and Conditions. This may include the gathering of information from the user or users involved and the complaining party, if any, and examination of material on Corporate Connect's servers and network. An investigation may suspend the account or accounts involved and/or remove material which potentially violates these Terms and Conditions. You hereby authorize Corporate Connect or their agents, to cooperate with law enforcement authorities in the investigation of suspected criminal violations, and system administrators at other Internet service providers or other network or computing facilities in order to enforce these Terms and Conditions. Such cooperation may include Corporate Connect providing the username, IP address, and/or other identifying information about a user. Upon termination of an account, Corporate Connect and its employees or agents are authorized to delete any files, programs, data and email messages associated with such account. The failure of Corporate Connect to enforce these Terms and Conditions, for whatever reason, shall not be construed as a waiver of any right to do so at any time. You agree that, if any portion of these Terms and Conditions is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect. The laws of the state Victoria govern these Terms and conditions. You agree to submit to the jurisdiction of the courts of that state.

Use of your Personal Information

For the purpose of processing your application and ongoing credit management of your account, Corporate Connect may need to disclose certain information to a credit-reporting agency. This information includes; personal identifying details, including your name, current and previous addresses, driver's license number, date of birth and employer; the fact that you have applied for the Service, and any credit limit on your account; the amount of any payments which are overdue for at least 60 days, when steps have been taken by Corporate Connect to recover those overdue payments; where an overdue payment has been previously reported, advice that the payment is no longer overdue; cheques or credit card payments which have been dishonored; court judgments or bankruptcy orders made against you; that, in the opinion of Corporate Connect, you have committed a serious credit infringement; and when Corporate Connect ceases to provide the Service to you. You authorize Corporate Connect to disclose that information to a credit-reporting agency. You also authorize Corporate Connect to seek from or give to any credit providers nominated by you or named in a credit report or to other telecommunications providers, and Corporate Connect's agents, or contractors, the same information and any other information in your application and any other information on your creditworthiness, credit history or credit capacity that credit providers are allowed to give under the Privacy Act.

Termination of Account

Corporate Connect may suspend or terminate the Service if you breach these Terms and Conditions (or Corporate Connect suspects you have breached these Terms and Conditions). Corporate Connect will endeavour to give you notice of such suspension or termination. Corporate Connect may, in its absolute discretion, re-connect you to the Service after such a suspension if you undertake to comply with these Terms and Conditions in the future. Corporate Connect may charge you a re-connection fee in these circumstances. Corporate Connect may also suspend the Service, at any time without notice, for any reason including but not limited to, technical reasons, network repairs, or to comply with any law or an order of an emergency service or government authority. You may terminate the Service by giving Corporate Connect 30 days notice. You must pay for the Service up until the end of the notice period. If you have agreed to take the Service for a Minimum Period and you seek to terminate early, a cancellation fee may apply and you may do so on the condition that you pay the Charges for the duration of the Minimum Period.

Annual payment

Annual payment of account will be seen as pre paid service. This offers customers access to the Corporate Connect network at a fixed rate of charge, this insures no further charges for the service during the period purchased. [Excludes breaches of the Terms & Conditions].

In the event of termination of service at customers request, Corporate Connect will require 30 days written notice prior to disconnection. At the date of disconnection Corporate Connect will calculate the period remaining within the pre paid plan and calculate the value of this period. The amount owing or deemed refundable will equal the remaining period value less a 20% account discharge fee. The refundable amount will be forwarded to the account holder within 20 business days.

Disputes

You may complain about the Service in writing or orally by calling one of Corporate Connect's customer service representatives. Corporate Connect will  endeavor to resolve your complaint. If Corporate Connect is not able to resolve your complaint to your satisfaction, you may refer your complaint to the independent Telecommunications Industry Ombudsman. www.tio.com.au
